License Agreement
Balanced Architecture, LLC assumes no liability for any home, portion of a home, or other structure which may be built from these plans. The purchaser of these plans is responsible for reading and complying with the following before the start of construction.
USE OF PLANS
- These Plans are the property of Balanced Architecture, LLC. These Plans are protected by Federal Copyright Laws. Any use of the information contained herein beyond the one-time use authorized by a purchase of the Plans, or any duplication, publication, sale or distribution of any part of these Plans without the prior written consent of Balanced Architecture, LLC represents a violation of Federal Laws subject to the prescribed penalties.
- Purchase and downloading of any PDF or CAD plan package grants the purchaser as “Licensee” the right to use such documents to construct a single home. A single purchase of the plans allows duplication of prints solely for that purpose. Purchaser acknowledges that all rights of ownership, title, and interest in the copyrights, plans and derivatives remain with Balanced Architecture, LLC.
- Modified plans are considered derivatives of the original and receive the same copyright protection even if completely redrawn.
- This License for use of the Plans ends with the completion of the house or abandonment of the construction project for which the License was acquired. This limited License is personal to Licensee, and Licensee acknowledges that the Plans and License are not transferable to a third party.
- Any use of the Plans, or modifications of the Plans, by purchasers, builders or others is done at their own risk. Licensee shall have the Plans reviewed by a local professional architect or engineer before the start of construction. The information contained within the plans is to indicate design intent and basic construction detailing. It is the builder’s responsibility to provide standard construction details and practices which will result in a structurally sound and weatherproof finished product.
- These drawings have been prepared to meet generally accepted professional standards and practices, but have been developed without knowledge of or reference to the Licensee’s specific site or geographical location. Local site conditions, such as frost depth, soil bearing capacity, seismic and wind zones, exposure, etc. may vary. Local code requirements for such life-safety requirements as stair width, stair rise and run, egress windows and smoke detectors, etc. may vary. The strength of materials (such as lumber) available locally may vary. Therefore, supplemental to these documents, it is the Licensee’s responsibility to consult with their local builder and a professional designer or structural engineer to determine that these documents meet all current federal, state/provincial and local codes, ordinances/bylaws and regulations, etc., and are appropriate to specific site conditions. Compliance with such requirements shall take precedence over these documents.
- Any use of this information without adaptation to changes in codes, standards, site conditions and other factors is at the Licensee’s sole risk. Balanced Architecture, LLC assumes no responsibility for changes made to these plans by others and makes no warranties, either expressed or implied, in the use of these plans. The Licensee agrees to defend and indemnify Balanced Architecture, LLC for all claims, costs, losses or damages resulting from the use of these documents.
- Before starting construction, it is the builder’s responsibility to check all dimensions and details, and verify conformance with governing code requirements for the geographic area in which the house is to be built. All structural, mechanical and electrical requirements shall also be reviewed before construction begins. Codes govern over drawings and dimensions govern over scale. Notify the architect of dimensional discrepancies.
- Balanced Architecture, LLC has not been engaged for construction supervision of any kind and assumes no responsibility to ensure that construction conforms to these plans, nor has any responsibility for construction means, methods, techniques, sequences, procedures or safety precautions in connection with the work.
